The regional office of the Department of Human Settlements and Urban Development (DHSUD 11) is running after illegal subdivision developers in Davao Region.
DHSUD OIC regional director lawyer Miguel Palma Gil told media in Connect media forum that his office is going after several illegal developers who established subdivision projects in Island Garden of Samal (IGaCoS), Indangan, and Communal in Barangay Buhangin, Davao City.
Palma Gil said illegal developers subdivided the Certificate of Land Ownership Awards (CLOAS) in a piecemeal way.
“Piecemeal ang pag-subdivide na wala development permits. Mga CLOAS sa Samal gi-subdivide I don’t know why gi-allow ng ROD na i-subdivide ang smaller lots. Muagi ka pa dapat ana sa among agency, sa Department of Environment and Natural Resources (DENR), Department of Agriculture (DA) ug local government units. So please avoid buying without license. Marami na in Davao Region. Those are the things that I am looking into into right now,” he said.
He said on February 27, he and Roy Ryan Rigor, chief of Housing and Home Site Division of the City Planning and Development Office (CPDO) conducted a joint inspection in Communal and Indangan areas upon the order of Mayor Sara Duterte-Carpio.
“We were ordered by the mayor to look into the problem kasi may nag raise na resident na yung kanal daw nila na- block only to find out na yung subdivision nila is an illegal subdivision project. Wala silang proper na kanal system, walang proper road networks. I really dont know the name kasi wala siyang license in cimmunal area. Kawawa yung nakabili. Tinanong ko sino ang nagbebenta, di na daw ma locate,” he said.
Palma Gil said there is a need to strengthen Task Force Presidential Decree 957, a law that seeks to regulate the sale of subdivision lots and condominiums in view of the increasing number of incidents wherein “real estate subdivision owners, developers, operators, and/or sellers have reneged on their representations and obligations to proved and maintain properly” the basic requirements and amenities, as well as “reports of alarming magnitude… of swindling and fraudulent manipulations perpetrated by unscrupulous subdivision and condominium sellers and operators.”
“This is to go after those illegal subdivision developers and to file criminal complaints against them because they are mandated by law to provide minimum standards set by PD 957 para sa ilang mga buyers and clients. Unfortunately daghan illegal karon piecemeal ilang ginabuhat subdivide. Two meters lang ang dalan, walay linya sa tubig ug kuryente,” he said.
Palma Gil said they already initiated the filing of cases of administrative and crminal cases against these illegal subdivision developers.
“Rest assured I will go after these illegal subdivision developers. Dumami na silq ngayon. Ang uban lote lang ginabaligya, beachfront kunuhay sa samal. Rest assured that in the following months we will update you on this issue. Sa mga nag co-comply na developers medyo lenient ako, I allow them to submit documents. But huwag binili ng projects na walang license to sell, ” Palma Gil said.
