The International Criminal Court (ICC) has announced that it will hand down its decision on the interim release appeal of former President Rodrigo Duterte on November 28, 2025.
In a scheduling order, the ICC Appeals Chamber said judgment on Duterte’s appeal filed against the Pre-Trial Chamber I’s September 26 ruling denying his requests for interim release will be delivered in open court on the said date.
The order was issued pursuant to Article 83(4) of the Rome Statute and Rule 158(2) of the ICC Rules of Procedure and Evidence.
The notice was signed by Presiding Judge Luz del Carmen Ibáñez Carranza.
In June this year, FPRRD’s legal team sought interim release, citing his age and deteriorating health.
His legal team has argued that interim release is warranted on grounds of due process and jurisdiction.
The ICC Prosecutor, however, has urged the chamber to reject the request, maintaining that the Court has clear authority to continue with the case.
The Philippine government has reiterated that it will not cooperate with the ICC probe, insisting that domestic mechanisms remain capable of handling relevant investigations.
Meanwhile, the ICC asserts jurisdiction over alleged offenses committed while the Philippines was still a State Party to the Rome Statute.
The former president has remained in detention in the Netherlands since his arrest earlier this year, after the ICC authorized a probe into alleged crimes against humanity linked to his administration’s anti-drug campaign.
