ICC Appeals Chamber to issue decision on Duterte jurisdiction challenge on April 22

The Appeals Chamber of the International Criminal Court (ICC) is set to issue its decision on the jurisdiction challenge filed by the defense team of former president Rodrigo Duterte later this month.

In a statement, the chamber said the ruling will be delivered in open court on April 22 at 11 a.m. (Netherlands time).

Duterte’s legal team filed the appeal in October, contesting an earlier decision by Pre-Trial Chamber I that allowed the ICC prosecutor to proceed with an investigation into alleged crimes against humanity linked to the administration’s anti-drug campaign.

The defense argued that there is no legal basis for the continuation of proceedings against Duterte, maintaining that the ICC no longer has jurisdiction over the Philippines following its withdrawal from the Rome Statute in 2019.

Duterte was arrested on March 11, 2025, and was subsequently transferred to The Hague, where he remains in detention.

The Appeals Chamber had previously denied his request for conditional release, ordering that he stay in custody while proceedings continue.
