City hall creates internal investigating committee

An internal investigation committee has been created to receive and address complaints raised against plantilla local government employees inside Davao City Hall.

Executive Order No. 6 series of 2017, signed last February 22, 2017, is an order creating the investigating committee and its secretariat, and identifying the special administrative prosecutors, and defining the respective powers, functions and duties thereof.

The investigating committee will be in-charge of conducting administrative proceedings relative to complaints made against employees of the City Government.

It will be composed of Atty. Osmundo P. Villanueva Jr. as the chairman, Atty. Lawrence D. Bantiding of the City Legal Office and Erwin Alparaque of the Human Resource Management Office as members.

During the Ispeak Conference held at the Davao City Hall on Thursday, Atty. Enrique Bonocan said that the possible punishments which will be given to the employee, if proven guilty, could be suspension for certain number of days up to dismissal from service, depending on the gravity of his/her offense. Grave offenses include embezzlement of public funds.

The EO said that the committee has the power to conduct investigations pursuant to the Rule 8 of the Revised Rules on Administrative cases in the Civil Service, and Section 86 of Republic Act 7610 otherwise known as the Local Government Code of the Philippines, and thereafter submit the findings and recommendations to the city mayor upon the conclusion of the same.

They will also be conducting necessary proceedings, conferences, hearings and other lawful processes to appropriate individuals relative to a complaint filed against an employee of the City Government.

The EO also identified special administrative prosecutors who shall prosecute administrative actions in the person of Atty. Enrique J.A. Bonocan, Atty. Marlisa A. Gallo and Atty. Janis Louis Esparcia.

Since the signing of the EO last February 22, 2017, the investigating committee has received around 15 reports, some includes falsification of Daily Time Records by city hall employees.

According to Atty. Bonocan, in the past administration when President Rodrigo Duterte was still the city mayor, the City Legal Office has dismissed ten (10) plantilla employees, mostly coming from the City Treasurer’s Office, on the ground of money embezzlement.
